Terms
This payment confirms your spot on a boat. The payment is non-refundable, except where another sailor is found to take your place should you no longer be able to join the trip. In that instance a refund will incur a 3% handling fee. DC Sailing Community reserves the right to revoke your booking for any reason.
Tier 1 berth fee’s are calculated based on the total cost of all Tier 1 boats divided by the total number of Tier 1 double occupancy cabin berths so that everybody on a Tier 1 boat pays the same to join the flotilla (excludes Skippers)., subject to discounts offered at DC Sailing Community’s discretion. Any additional crew added by a Skipper that exceeds the advertised number of berths available on a given boat are added at the Skippers sole discretion and DC Sailing Community bears no responsibility for additional crew management that may be required or higher crew expenses incurred as a result. The per person cost for additional crew remains as originally calculated for the advertised available berths, and applies to any additional crew. All boats are of a similar specification. If multiple boats are cancelled for any reason and we are unable to sail, refunds are not typically issued by the charter company except under extreme circumstances. If such circumstances arise and the charter company refunds the costs of the boats, refunds to crew will be applied based on the same average cost model, less handling fees.
If we need to replace the boats with those from another vendor for any reason, and the total cost is cheaper, partial refunds will be calculated based on the same average cost model, with no exceptions. If the trip is cancelled by the charter company and refunds are not issued, monies paid will be held by the charter company and used for a future charter. Each crew member will have first refusal on that next charter. If a crew member is not able to attend a credited charter they will be refunded only when another sailor is found to take his/her place. These terms are applied equally across the flotilla fleet. Registering for the flotilla constitutes acceptance of these terms.
Prior to departure you may be asked to provide some additional information that will help the planning and enjoyment of the trip go smoothly.
All participants of "Cruising Adventures" must agree to indemnify and hold DC Sailing Community and its affiliates and skippers harmless for any injury or death arising from swimming, windsurfing, kayaking, or the use of dinghies, snorkels, masks, scuba equipment, operation of the vessel, or other equipment, the use of drugs, consumption of alcohol, unauthorized motoring, sailing or motoring in areas designated as hazardous by DC Sailing Community or the charter companies it engages with. DC Sailing Community and its skippers are not held accountable for any injury caused by malfunction of a vessel that is not owned and maintained by DC Sailing Community. In the case of an injury, the crew member remains responsible for the negligent acts that may result in harming the crew member and fellow crew.
The DC Sailing Community skipper has the right to suspend the activity and participation of a crew member on any DC Sailing Community 'Cruising Adventure' if behavior is deemed to be erratic, unsafe, belligerent, or defiant of the Skipper's commands and orders. Registrant will not be refunded and will be responsible for any and all extra financial costs if they are required to disembark before the end of the trip. Erratic and unsafe behaviors includes but is not limited to excessive drinking of alcohol, unsafe practices aboard, damaging the boat, willful defiance of the Skipper and their commands (in regards to safety), sexual harassment, physical and verbal violence. It is the right of the Skipper to judge erratic behavior has they deem fit for the situation.
